Mike Whitney's article on Guantanamo Trials quoting me
 

Dear Dr. El-Najjar,

I was pleased to see portions of an article of mine quoted in Mike Whitney's piece "Guantanamo 'Mock Trials.'" 

Mr. Whitney, however, misquotes me at one point.  He writes that "Perhaps, Justice Scalia (inadvertently) summed it up best, (recorded by Van Bergen) We 'can point to no case or other authority for the proposition that those captured on a foreign battlefield . . . cannot be detained outside the criminal process.'"

As I wrote in my article, this was a criticism in the plurality decision in the Hamdi case against Scalia's dissenting opinion.  It was not part of Scalia's opinion.  The plurality opinion was written by Justice Sandra Day O'Connor and joined by Chief Justice Rehnquist, and Justices Kennedy & Breyer.  (Separate opinions were filed by Justices Souter & Ginsburg, concurring in the result but disagreeing with parts of the opinion.  Thus, six justices joined in the result, but only four in the opinion.  This is why it is called a plurality opinion.  Justices Thomas and Scalia dissented for completely opposing reasons.  Thomas dissented because he felt that the Court should have given more deference to the President's "unlawful enemy combatant" determinations, and Scalia dissented because he felt, as I do, the process required for habeas corpus was equal to procedures used in criminal cases.)  The opinion can be found at:  http://supct.law.cornell.edu/supct/html/03-6696.ZS.html

Palestinian prisoners are on hunger strike

Israeli prison wardens are using what they would maybe term psychological methods to get the prisoners on hunger strike to eat; by cooking outside the prisoners' cells and by eating in front of them, thinking maybe they would be tempted to eat.

The wardens are not motivated by the welfare of the prisoners. These are the prisoners routinely beaten and tortured. Instead the wardens and the Zionist government want to torment the prisoners into giving up their hunger strike.

These prisoners are not eating to draw attention to their plight of being arrested and detained for no other reason than being Palestinian. Hopefully more people will come to realise that Israel is committing genocide instead of listening to the Zionists.

Please explain to the writer (Fawaz Turki-m.moore movie) that Bowdlerism is nothing new in history.

In fact, the cnn station gave a report (8-19-04, Wolf Blitzer report) on how the United States government desires to bludgeon the standards of depravation into Arabic school texts.

The American fetidness of teaching seven and eight year olds to depucelate should not be TOLERATED.

Appeasement of American heteronomy is not a wise path to travel.
